Welcome to Whiskey Source. These Terms and Conditions ("Terms") govern your use of the Whiskey Source website at whiskeysource.com (the "Site") and the purchase of products and participation in auctions offered by Whiskey Source LLC ("we," "us," or "our").

By accessing or using our Site, creating an account, making a purchase, or placing a bid, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Site or services.

To make purchases or place bids, you must create an account. When creating an account, you agree to:

• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Shop Purchases

4.1 Product Listings

Products listed in our shop are available for immediate purchase at the listed price, subject to availability. We make every effort to display product information accurately, including descriptions, images, and pricing. However, we do not warrant that product descriptions, images, or other content are accurate, complete, or error-free.

4.2 Pricing and Availability

All prices are listed in U.S. Dollars (USD) and do not include applicable taxes or shipping costs unless otherwise stated. We reserve the right to change prices at any time without notice. If a product is listed at an incorrect price due to an error, we reserve the right to refuse or cancel orders placed at the incorrect price.

4.3 Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraud or unauthorized transactions.

5. Auction Terms

5.1 Bidding Process

When participating in our auctions, you agree to the following:

• All bids are binding and irrevocable once placed
• You are responsible for all bids placed under your account
• Bids must be made in good faith with the intention to purchase if you win
• We use a proxy bidding system where your maximum bid is kept confidential
• The current bid will increase incrementally up to your maximum bid as needed

5.2 Auction Extensions

To prevent last-second bidding ("sniping"), if a bid is placed within the last 10 minutes of an auction, the auction end time will automatically extend by an additional 10 minutes. This process will repeat as long as bids continue to be placed within the final 10 minutes.

5.3 Winning an Auction

If you are the highest bidder when an auction ends:

• You are obligated to complete the purchase at your winning bid price
• You will be notified via email within 24 hours
• You must complete payment within 24 hours of auction end
• Failure to complete payment may result in account suspension and forfeiture of the item
• We may relist the item and pursue collection of any difference in final sale price

5.4 Reserve Prices

Some auctions may have a reserve price (minimum acceptable price). If bidding does not meet the reserve price, we are not obligated to sell the item. Reserve prices are confidential and will not be disclosed.

5.5 Right to Cancel

We reserve the right to cancel any auction at any time before completion for any reason, including but not limited to: product no longer available, pricing errors, suspected fraud, or violation of these Terms.

6. Payment

6.1 Payment Methods

We accept payment via credit card, debit card, and other methods processed through our payment provider, Stripe. All payment information is processed securely and in compliance with Payment Card Industry (PCI) standards.

6.2 Authorization

By providing payment information, you authorize us to charge the applicable amount to your payment method. You represent and warrant that you have the legal right to use any payment method provided.

6.3 Taxes

You are responsible for paying all applicable federal, state, and local taxes associated with your purchase. We will collect sales tax where required by law based on your shipping address.

7. Shipping and Delivery

7.1 Shipping Locations

We ship only to addresses within the United States. We do not ship to P.O. boxes or international addresses. Shipments may be restricted in certain states or localities based on local alcohol shipping laws.

7.2 Shipping Costs

Shipping costs are calculated based on the weight, dimensions, and destination of your order. Shipping costs will be displayed before you complete your purchase. We ship via UPS and use secure, insured shipping methods.

7.3 Delivery and Signature

Due to the nature of our products:

• Adult signature (21+) is required for all deliveries
• You or another adult 21+ must be present to receive the shipment
• Valid government-issued photo ID will be required upon delivery
• We are not responsible for delays caused by absence at delivery address

7.4 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier. We are not liable for any loss, damage, or delay once the shipment has been picked up by the carrier, though all shipments are fully insured.

7.5 Damaged or Lost Shipments

If your shipment arrives damaged or does not arrive, please contact us immediately at support@whiskeysource.com. We will work with the carrier to file an insurance claim and resolve the issue.

8. Returns, Refunds, and Cancellations

8.1 General Policy

Due to the nature of alcoholic beverage sales and state regulations, we generally cannot accept returns of opened bottles or products that have been delivered. However, we stand behind the quality and authenticity of our products.

8.2 Defective or Damaged Products

If you receive a product that is defective, damaged, or not as described, please contact us within 48 hours of delivery. We may require photographic evidence. We will, at our discretion, offer a replacement, refund, or store credit.

8.3 Order Cancellation

You may cancel an order before it ships by contacting us immediately. Once an order has shipped, it cannot be canceled but may be eligible for return under our return policy. Auction purchases cannot be canceled after the auction ends.

9. Product Information and Authenticity

We strive to provide accurate product descriptions, including distillery, age, proof, bottle size, and condition. However, we cannot guarantee the accuracy of all information, especially for rare or vintage bottles. All products are sold "as is" unless otherwise stated.

We source our products from reputable sources and take authenticity seriously. However, we make no warranties regarding the authenticity of products unless explicitly stated. For high-value items, we recommend obtaining independent authentication.

10. Prohibited Uses

You agree not to use our Site for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include, but are not limited to:

• Providing false or misleading information
• Impersonating another person or entity
• Engaging in fraudulent bidding or purchasing activities
• Attempting to manipulate auction results
• Using automated systems or bots to access the Site
• Attempting to gain unauthorized access to our systems
• Reselling products in violation of applicable laws
• Using the Site if you are under 21 years of age

All content on the Site, including text, graphics, logos, images, and software, is the property of Whiskey Source LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. 15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Whiskey Source LLC regarding your use of the Site and supersede all prior agreements and understandings.
